Q: Our parish Council has another casual vacancy for a Councillor. Our Parish Council decided not to go for a by-election but to co-opt instead. Do they have to repeat that process again?

A: Yes. What would happen if government decided in cabinet not to call a bye election when an MP retired? It is the electorate of the parish who must be asked if they want a bye election BEFORE co-option.

It is this rather cavalier attitude of Parish Councils towards the law and best practice that contributes to the bad image our sector has in some quarters.
